O-1 Visa

Qualifying for an O-1 visa is more common than one might think.

The O-1 visa is a work visa designed for individuals with extraordinary abilities in fields such as science, arts, education, business, or athletics, as well as those who have achieved significant success in the film and television industry. This visa is often referred to as the “celebrity visa,” widely recognized because of its use by famous figures like Justin Bieber, David Beckham, and Rihanna. However, qualifying for an O-1 visa is more common than one might think, as early-stage startup founders, successful artists, researchers, and engineers also utilize it to live and work in the U.S.

Key Features of the O-1 Visa

  • Non-Immigrant Status: The O-1 visa does not allow for direct Green Card applications. However, it can be renewed an unlimited number of times.
  • Dual Intent: Unlike other non-immigrant visas, the O-1 visa permits dual intent, meaning applicants are not required to demonstrate ties to their home country or an intention to return. O-1 visa holders can apply for a Green Card while maintaining their status.
  • Extraordinary Ability Requirement: To qualify, an applicant must demonstrate extraordinary ability, which generally means being in the top small percentage in their field. This can be proven by having won a one-time major award (such as a Nobel Prize) or meeting at least three of the following criteria:
Receipt of a nationally or internationally recognized award.
Membership in an organization that requires outstanding achievements for membership.
Published articles in professional journals or major media outlets.
Evidence of significant media coverage of the applicant's work.
Participation as a judge of the work of others in the same field.
Letters of reference from prominent colleagues affirming the applicant’s contributions.
Serving in a critical role for a reputable organization.
Receiving a higher salary than others in the same field (usually applicable to academic positions).

Categories of O-1 Visa

The O-1 visa is divided into two categories:

O-1A Visa: For individuals with extraordinary abilities or achievements in science, education, business, and athletics. Examples of qualifying professions include entrepreneurs, respected professors, researchers, computer scientists, CEOs, medical professionals, and data scientists.
O-1B Visa: For individuals with extraordinary abilities or achievements in arts, film, or television. Eligible individuals include award-winning directors, famous actors, innovative chefs, renowned fashion designers, acclaimed dancers and choreographers, and well-known visual artists.

Additionally, accompanying individuals such as performers or athletes can apply for an O-2 visa, while the spouses and children under 21 of O-1 visa holders can apply for an O-3 visa. The O-3 visa allows them to study in the U.S., but they do not have work authorization.
